Kroy Biermann Faces Lien from Divorce Attorney Over Alleged Unpaid Fees

According to Paras Griffin/Getty Images, Kroy Biermann’s attorney Marlys A. Bergstrom has filed a lien against him for alleged unpaid bills amid his divorce from estranged wife Kim Zolciak-Biermann.

Documents filed and obtained by We on Monday, December 4, show that Bergstrom’s law firm of Stearns, Montgomery & Proctor filed a Consent Attorney’s Lien for $801.01 against all of Biermann’s recoverable property relating to any judgments or decrees in his divorce from Zolciak-Biermann. The filing states that the unpaid fees and services include Biermann’s ongoing legal matters through November 15, as well as any interest accrued from Biermann’s August 24 agreement with the firm. A lien is a legal tool used to protect the interests of creditors and others owed money by property owners, according to Forbes.

Interest on the lien will accrue at a rate of 1.5% on all months due until Stearns, Montgomery & Proctor is fully paid for legal services and expenses incurred on behalf of Biermann, as provided by law and with Biermann's express written consent.

No one is allowed to satisfy any judgment or decree in this matter until the Firm's lien is satisfied, as it takes priority over all recoverable assets, including Biermann's money and personal or real property, such as his shared Georgia home with Zolciak-Biermann.

After marrying in 2011, both Biermann and Zolciak-Biermann filed for divorce in May, but reconciled in July. Biermann filed for divorce a second time in August, stating that their marriage was "irretrievably broken." They have been involved in a messy legal battle since then.

In August, Biermann requested full legal and physical custody of their minor children - Kroy "KJ" Jr., 12, Kash, 11, and twins Kaia and Kane, 9, as well as exclusive access to their Georgia residence, which he put on the market shortly after. (Biermann also adopted Zolciak-Biermann’s two eldest daughters, Brielle, 26, and Ariana, 22.)

Biermann hopes that selling the house will bring in "enough income to secure their own separate residences, and thus remove the children from the toxic environment."

The Biermann and Zolciak-Biermann home was scheduled to go into foreclosure on November 7. However, documents obtained in October revealed that both Biermann and Zolciak-Bieramnn submitted affidavits outlining the devastating impact of the foreclosure on their family. They also mentioned that their home is currently listed for $6 million.

The estranged couple has been dealing with multiple financial troubles, including lawsuits from J.P. Morgan Chase Bank and a debt collection company. Biermann was sued for $13,071.88 in credit card debt, while Zolciak-Biermann faced a $156,000 lawsuit for stopping payments on her HSBC/Saks credit card. Additionally, they were ordered to pay nearly $230,000 to Simmons Banks after defaulting on a home equity line of credit. The exes also owe the IRS $1.1 million in unpaid taxes.
