Kim Zolciak-Biermann is feeling incredibly distraught about not being able to attend her recent divorce hearing with Kroy Biermann. According to an exclusive source, she is devastated by the situation. The insider explains that Kim had no alternative but to miss the hearing as she was overseas, working on the show The Surreal Life. Due to production constraints, she was not permitted to return to the United States for the hearing.

The source revealed that the former cast member of The Real Housewives of Atlanta had a necessity to earn income. The source went on to state that the estranged couple currently possesses no financial resources and are financially unstable. On Wednesday, September 27, Zolciak-Biermann's absence from her Zoom hearing caused surprise and provoked anger from Fulton County Superior Court Judge Shermela J. Williams.

Zolciak-Biermann's lawyer, David Beaudry, admitted that she was flying from Colombia to Georgia when questioned about her whereabouts.

"She was expected to be present today as her presence was not waived," Beaudry stated apologetically to the judge. "I did not waive her presence."

The judge scheduled a fresh hearing on Friday, September 29, deeming Wednesday's meeting as futile. Williams emphasized the necessity for the presence of all parties during the upcoming session. Biermann also adopted Zolciak-Biermann's two oldest daughters, Brielle (26) and Ariana (21), from previous relationships.

Recently, Zolciak-Biermann requested for Biermann's second divorce petition to be dismissed. In her paperwork on Monday, September 25, she argued that Biermann's claim of a broken marriage was untrue because they had resumed living together.

Zolciak-Biermann claimed that she and Biermann had engaged in sexual relations after Biermann filed for divorce again. She stated that their most recent encounter took place around September 7, 2023.

In response to Zolciak-Biermann's petition, Biermann submitted his own filing on Tuesday, September 26. He stated that he has no intention of reconciling with his estranged wife.

He stated that his engagement in sexual relations with [Zolciak-Biermann] does not imply a desire for reconciliation. Additionally, [Biermann] remains resolute in his intent to depart from [Zolciak-Biermann], leave their marital residence, and create a calm and stable home for their children, contrary to the present environment.

Moreover, Biermann asserted in the filing that Zolciak-Biermann was attempting to prolong their divorce proceedings in order to stay in their shared home for a longer duration. Nevertheless, the Georgia house is scheduled for foreclosure in November.

“[Zolciak-Biermann] has expressed her preference to declare bankruptcy, a strategic decision aimed at ensuring that both parties and their children continue to live together in the same house for a considerable period of time," read the court documents. "Due to the absence of funds acquired from selling the marital property, the parties are unable to afford relocating to alternative residences."
