Baumgartner, aged 49, has recently made claims in court documents obtained by We on Wednesday, Jun 21, stating that Costner, aged 68, is resorting to "public attacks" in an attempt to force her to vacate their residence without a temporary child support agreement in place. However, Baumgartner argues that she is unable to leave their home due to a lack of funds to sustain their current family lifestyle.
Baumgartner asserts that she does not have any personal income and alleges that Costner made a $1 million payment to her as per the prenuptial agreement, which was deposited into an account without her consent or knowledge. In the filing, Baumgartner states that she has instructed for the funds to be returned to Costner.
Baumgartner alleges that Kevin is pressuring her to accept the validity of the spousal support limitation by accepting these funds. She believes that Kevin's intention is to make her use this money so that he can argue that she has given up her right to challenge the premarital agreement.
In May, it was confirmed that Baumgartner filed for divorce from Costner, citing irreconcilable differences as the cause of their separation. Although the 30-day period mentioned in the prenup has passed, Baumgartner's lawyer stated last week that Costner does not have any legal authority to evict his estranged wife and their children from their long-standing family residence.
Baumgartner's lawyer, John Rydell, expressed in court documents, "The purpose of this RFO is to evict Christine and their three children from the house where they have resided their entire lives." Despite the lack of substantial legal grounds for Kevin's request to remove his wife and children from their home, Christine considers this issue of utmost significance. In response, Baumgartner denies Costner's accusations of refusing to leave the property.
"According to Wednesday's filing, Christine acknowledges that she and the children will eventually need to find a new home. However, she is currently unable to do so due to lack of financial resources. It is important for her to secure housing that will allow the children to maintain a similar standard of living as they have in both parents' homes."
After their separation, Costner reportedly expressed surprise and a desire to reconcile. An exclusive source told Us, "He genuinely loves her and is making efforts to win her back. This situation has caught him off guard."
Baumgartner argues in her recent filing that Costner insisted on being the first to inform their three children about their divorce. She claims that Costner, who was in Las Vegas at the time, informed the kids through a 10-minute Zoom call without her presence. Baumgartner emphasizes that the well-being of their children has always been her top priority, and she was concerned that they would learn about the divorce before she and Costner had the opportunity to inform them together in person. She communicated this to Costner and even shared several articles highlighting the significance of presenting a united front when discussing such matters with children.
