Among the outlined expenses was an alleged $25,000, taken from Costner's property funds, which was paid to a criminal defense lawyer in Los Angeles. Additionally, Baumgartner had purchased an expensive vehicle months before their separation, raising suspicions. Costner had previously claimed that he was compelled to reduce his ex's credit card limit to $30,000 per month due to her extravagant spending. Costner's legal team argued that Baumgartner's car purchase was concerning, as they had typically chosen to lease vehicles before their split. According to the prenuptial agreement signed by Costner and Baumgartner prior to their 2004 marriage, she is entitled to retain her personal vehicle in the event of a breakup.

According to his lawyers, Baumgartner's recent purchase indicated that she had been planning to leave long before she informed Kevin in April 2023. They also claimed that Baumgartner declined to agree to not take any belongings from their home when instructed to move out.
