Kim Zolciak-Biermann and Kroy Biermann are going to have to say goodbye to their Georgia mansion.
Truist Bank has stated in court documents obtained by We on Friday, January 12, that they have the "right" to foreclose on the estranged couple's home. According to the paperwork, Zolciak-Biermann, 45, and her estranged husband, 38, have "defaulted on their mortgage," and the bank "intends to exercise its rights" to foreclose on the home if their debt isn't paid. Biermann had previously requested a restraining order against the foreclosure, but Truist Bank's filing argues that this "must be denied."
The house drama began in November 2022 when The Real Housewives of Atlanta alum took to social media to deny any financial issues with Biermann and insisted that their home was not up for sale. However, in February 2023, it was confirmed that the Georgia mansion was in foreclosure and scheduled for auction the following month. This came after Truist Bank initiated the foreclosure process in August 2022 due to the couple's mortgage default.
The auction scheduled for late February was abruptly canceled, without any additional information provided. In the midst of their housing troubles, Zolciak-Biermann and Biermann initiated divorce proceedings in May 2023 after being together for 11 years. Following a reconciliation and the abandonment of the initial breakup, Biermann once again filed for divorce in August 2023.
Biermann's second divorce petition requested full legal and physical custody of their four minor children and asked that their Georgia home be sold before it was foreclosed on in November 2023. The former couple's children include sons Kroy "KJ" Jr., 12, and Kash, 11, as well as twins Kaia and Kane, 10. Biermann also legally adopted Brielle, 26, and Ariana, 22, who are Zolciak-Biermann’s daughters from a previous relationship.
In October 2023, Us confirmed that the Zolciak-Biermann house was listed for $3.2 million. The price was later raised to $6 million, but has now been reduced to $5.5 million.
The estranged couple submitted affidavits in October 2023 outlining the potential impact of foreclosure on their family.
Biermann expressed in court documents obtained by Us, "Losing this equity would have a devastating effect on my family, including myself, my ex-spouse Kim, and our four minor children. We would be left without a home, financial stability, and the means to address our marital debts."
He emphasized his close collaboration with Truist to prevent foreclosure, implementing a 3-month trial payment period from June to August of 2023. However, he and Zolciak-Biermann were unable to fulfill the August payment.

Zolciak-Biermann’s affidavit, meanwhile, detailed how the family “will face insurmountable financial hardships” if the foreclosure proceeds.
“We are pleading for your support in potentially expediting the sale of the house, under the condition of a temporary order from the court to prevent foreclosure,” she wrote.
