Kim Zolciak and Kroy Biermann Express Concerns Over Potential Home Foreclosure
Kroy Biermann and Kim Zolciak-Biermann fight to save their home from foreclosure amidst their difficult divorce, emphasizing the devastating impact losing their cherished property would have on their lives

Kroy Biermann and Kim Zolciak-Biermann are doing everything they can to prevent foreclosure on their shared Georgia mansion.
According to documents acquired by We, the estranged couple submitted affidavits on Thursday, October 25, detailing the detrimental impact foreclosure would have on their family. After Us confirmed in February that the property was going into foreclosure, the couple decided to list their home for sale earlier this month.
In his affidavit, Biermann, who is 38 years old, expressed the profound consequences that losing their equity would have on their family, which includes himself, his ex-spouse Kim, and their four underage children. He emphasized that they would be left homeless, lacking financial resources, and incapable of addressing the debts incurred during their marriage. These debts include the Truist mortgage, a Home Equity Line of Credit (HELOC) linked to the property, and an IRS lien.
Biermann stated that he collaborated closely with Truist in order to prevent foreclosure. They entered a three-month probationary payment period from June to August 2023. However, Biermann and Zolciak-Biermann, 55, were unable to make the August payment due to challenges arising from their ongoing divorce. As a result, the holding company decided to proceed with foreclosure.
Biermann emphasized that the property is currently listed for sale, as directed by the judge overseeing their divorce case. The sale would enable him and Zolciak-Biermann to fully repay Truist.
Zolciak-Biermann expressed in her sworn statement that both she and Biermann will experience significant financial difficulties as a result of the foreclosure. She emphasized that the most distressing consequence would be the impact on their children, who would be left without a home. (The couple shares sons Kroy "KJ" Jr., 12, Kash, 11, and twins Kaia and Kane, 9. Zolciak-Biermann is also the mother of daughters Brielle, 26, and Ariana, 22, from previous relationships.)
"We humbly request your support in possibly expediting the sale of the property, with the condition of a temporary court order to prevent foreclosure," added the former Real Housewives of Atlanta cast member.

In a petition filed on Thursday, the former spouses claimed that their residence is scheduled to be auctioned on November 7, 2023, at the courthouse. They stated that allowing the foreclosure to proceed would result in irreparable harm to the entirety of the marital estate.
Zolciak-Biermann and Biermann filed for divorce in May, briefly got back together in July, and then split again in August. In recent court documents, Biermann made it clear that he does not want to reconcile with Zolciak-Biermann, despite their post-split intimacy. He is determined to leave her, take the children, and create a calm and stable home environment for them, which is the opposite of their current situation.
Zolciak-Biermann was unable to attend a divorce hearing in September, which a source revealed was because she was out of the country filming The Surreal Life. The insider shared that Zolciak-Biermann had no other option as she needed to make money due to their financial struggles. In an attempt to alleviate the situation, she even tried selling Biermann's designer shoes on social media. Recently, Zolciak-Biermann filed court documents seeking primary physical custody of their four minor children, while still requesting joint legal custody with Biermann.
They were ordered to pay almost $230,000 to Simmons Banks for not responding to the bank's final default order. This legal issue arose from a lawsuit filed against them in July regarding their default on a home equity line of credit. Previously, a temporary order granted them "exclusive use" of their mansion until it is sold. Zolciak-Biermann will reside in the "basement/nanny suite," while Biermann will occupy the main bedroom.
