Erica Herman, Tiger Woods’ former girlfriend, has decided to withdraw her $30 million lawsuit alleging that he breached an oral agreement after their breakup. According to documents obtained on July 18th, the 39-year-old Herman dismissed the case, pending the outcome of her appeal regarding another lawsuit she filed. This second lawsuit aims to invalidate a nondisclosure agreement she had signed with Woods in 2017 and is still ongoing.
Herman initiated a lawsuit against Woods' trust, the owner of his home, in October 2022. She alleged that Woods violated their oral agreement, which allowed her to reside in his residence for a specific period of time in exchange for valuable services. According to documents obtained by us, Herman claimed that she was deceitfully locked out of the property, with five years remaining in their alleged agreement. She further stated that the fair rental value of the property for the remaining five years amounted to $30 million.
Woods' trust submitted documents in November 2022 to dismiss Herman's complaint. In their response, the entity argued that according to Herman's NDA with Woods, she was obligated to resolve any disputes with the golfer through private arbitration. The documents stated that by suing the trust instead of Woods himself, Herman was attempting to avoid her responsibility to resolve her claims confidentially and instead seek an advantage by litigating her disputes with Woods publicly. Additionally, the trust denied the existence of an oral tenancy agreement.
The hearing for Herman's lawsuit on the oral tenancy, which was originally set for August, was canceled according to a court document filed on June 29. The document stated that Herman dismissed the suit without prejudice, pending the resolution of the appeal in Herman v. Woods and the determination of whether her claims are subject to arbitration.
Days before the lawsuit was dismissed, Herman submitted her second appeal in an attempt to overturn the decision to throw out her case. The case involved her request to have her non-disclosure agreement with Woods lifted, citing claims of harassment by the athlete. According to documents obtained at the time, Florida judge Elizabeth Metzger found the sexual misconduct claims to be insufficient and lacking in detail.
In the preceding month, Herman filed legal documents alleging that Woods had sexually harassed her shortly after she started working at his Florida restaurant in 2014. Her legal team argued that Woods had coerced her into signing a non-disclosure agreement in 2017 by threatening to terminate her employment. Despite already being in a romantic relationship, her lawyers emphasized that a superior imposing different working conditions due to a sexual relationship constituted sexual harassment.
According to Herman's attorneys, Woods allegedly sexually harassed her again in 2022 by forcibly removing her from their residence and making her housing contingent on a sexual relationship with another tenant. They argue that this behavior constitutes sexual harassment under federal and Florida fair housing laws.
In response, Woods described Herman as a scorned ex-girlfriend who is choosing to publicly litigate baseless claims instead of abiding by their agreement to resolve disputes through confidential arbitration. He also criticized Herman's reliance on the Speak Out Act, a federal law designed to protect victims of sexual harassment and assault, as an abuse of the judicial process that undermines the statute's purpose and the individuals it aims to help.
