Seven former BioWare employees have filed a lawsuit against the developer, claiming they were treated poorly and seeking fair severance pay.
The employees claim that BioWare breached Canada's Employment Standards Code and presented inadequate terms during negotiations. This lawsuit further compounds BioWare's recent difficulties, casting doubt on the studio's capacity to replicate its previous successes, although the consequences of the legal action remain uncertain.
Seven ex-employees of BioWare have filed a lawsuit against the renowned game developer, claiming potential legal infringements after being terminated in August. BioWare, known for its revolutionary RPG franchises such as Mass Effect and Dragon Age, has faced challenges in recent years. Both Mass Effect: Andromeda and Anthem received mixed to negative feedback from gamers. Although Mass Effect: Legendary Edition, released in 2021, was better received, concerns remain about whether the once acclaimed studio can regain its former glory.
These doubts further intensified when BioWare announced the elimination of approximately 50 positions in August, aiming to streamline its workforce by either redeploying employees within its parent company EA or terminating their employment altogether. This came after EA's own round of layoffs earlier in the year, as part of an effort to restructure the major publishing company and reduce development expenses. While BioWare has reassured fans that these changes will not have a detrimental impact on upcoming titles like Dragon Age Dreadwolf and Mass Effect 4, some of the former employees who were let go are pursuing legal action.
Seven former workers laid off by BioWare in August have filed a lawsuit against the developer. The plaintiffs have submitted a Statement of Claim to Alberta's Court of King's Bench, seeking fair severance pay and punitive damages for what they consider "unreasonably poor treatment by BioWare." Representation for the employees is provided by R. Alex Kennedy, a lawyer from Worobec Law Offices. Kennedy has alleged that BioWare terminated these individuals without valid reasons, and there is a possibility that the developer may have violated Canada's Employment Standards Code by attempting to diminish the terminated employees' pay and benefits.
Allegations are being made that when they were let go, BioWare employees tried to negotiate with the developer, but the offers they received were unsatisfactory. One of the ex-BioWare employees involved in the lawsuit expressed their support for upcoming projects like Dragon Age Dreadwolf, but they are puzzled by BioWare’s actions and are struggling to find new employment before the holidays because they cannot share their recent portfolio work, which is currently under NDAs.
BioWare has been plagued with negative news in recent years, and this lawsuit filed by former employees adds to their tarnished reputation. As of now, neither BioWare nor EA has commented on this latest development, and it remains to be seen how the legal action taken by the former employees will impact the future.
