Jamie Foxx has been accused of sexually assaulting a woman while dining at a NYC restaurant in 2015.

TMZ obtained documents on November 22 indicating that an unnamed woman is suing 55-year-old Foxx and Catch NYC & Roof restaurant for compensatory and punitive damages. She alleges that she had to seek medical treatment and suffered pain and emotional distress due to "sexual assault, abuse, assault, and battery." Representatives for Foxx have yet to respond to We's request for comment.

According to the lawsuit, the woman claims that Foxx touched her inappropriately after she requested a photo with him inside the restaurant. She states that Foxx, who was sitting at a nearby table, agreed to the photo but then proceeded to comment on her appearance and scent.

While posing for a picture, Foxx reportedly began touching the woman by placing both hands on her waist and moving them under her top to fondle her breasts. Despite her attempts to break away from the actor, she claims that several people noticed but did nothing. Foxx then allegedly proceeded to touch the woman inappropriately by sliding his hands into her pants and touching her intimate areas. According to the woman, the alleged assault stopped when her friend intervened and saw what was happening.

The lawsuit was filed under New York's Adult Survivors Act, which was enacted last Thanksgiving. It allows sexual assault plaintiffs to file civil claims within a one-year window, regardless of the statute of limitations. The window for filing closes on Thursday, November 23. This story is ongoing.
