Tommy Lee faces a new lawsuit from an anonymous woman who claims he assaulted her. The lawsuit, filed on December 15 and obtained by Rolling Stone, accuses the 61-year-old drummer of sexual assault, gender violence, intentional infliction of emotional distress, and negligence. The woman, identified only as Jane Doe, describes the alleged incident as taking place in February 2003.
The plaintiff and the late David Martz were friends and he, being a pilot for Lee, invited her for a sightseeing helicopter ride around San Diego County. However, upon arrival, she was informed that they would be flying to Los Angeles with Lee instead.
The complaint states that Martz began to mix drinks shortly after takeoff. The plaintiff, Jane Doe, did not consume the drink she was given and alleges that Martz and Lee consumed alcohol, marijuana, and cocaine during the flight.
Martz allegedly instructed the plaintiff to "just relax" and directed her to sit on Lee's lap for a better view. Jane Doe contends that she succumbed to "enormous pressure," leading her to sit on Lee's lap, where he allegedly started touching and kissing her. When she tried to move away from Lee, the suit claims that he became more aggressive.
During the 40-minute trip, she accuses Lee of forcibly groping, kissing, and penetrating her with his fingers, as well as trying to coerce her into performing oral sex.
Initially, the plaintiff chose not to report the incident, as she believed it was an isolated one and did not think the police would believe her. However, she now claims that Martz and Lee had a history of engaging in indecent and illegal conduct on Martz's helicopter. She is seeking damages for medical expenses, loss of earnings, and loss of earning capacity.

Martz passed away in 2015 after facing multiple incidents involving the loss of his pilot's license. The Los Angeles Times reported that his license was revoked in 1986 for flying without proper registration and possessing a falsified medical certificate, in 2004 for operating with a suspended license and flying too close to people and property, and in 2009 for dangerously flying a helicopter while engaging in inappropriate behavior (allegedly receiving oral sex from a Swedish porn star). Additionally, Martz faced disciplinary action for landing an aircraft on a public road and without a permit in 2006 when he landed a helicopter in Hollywood Hills to take someone to a concert. In 2009, Martz was detained on suspicion of flying while intoxicated at Van Nuys Airport after flying near a Los Angeles police helicopter while in the company of someone. However, a Breathalyzer test produced inconclusive results.
