In August 2022, Heche tragically passed away at the age of 53 after being involved in a serious car accident. The Los Angeles Police Department reported that Heche was allegedly driving at a high speed when she lost control of her vehicle and crashed into a house. The impact caused her car to burst into flames, resulting in severe burns and a pulmonary injury that left her in a coma. Several days later, her representative disclosed that she had suffered a "severe anoxic brain injury" as a result of the accident and her prognosis was bleak.

One week later, it was confirmed that Heche died as a result of inhaling smoke and sustaining thermal injuries. Her cause of death was deemed accidental, with a "sternal fracture due to blunt trauma" from the car crash listed as another significant factor.

After her unfortunate death, Heche's 21-year-old son, Homer, whom she had with ex-husband Coleman Laffoon, spoke about the loss of his mother. (Heche also had a son named Atlas, 14, with ex-boyfriend James Tupper.)

"My brother, Atlas, and I have experienced the loss of our mother. Over the course of six tumultuous days, our emotions have swung to extremes, leaving me with a profound and indescribable sadness," Homer expressed in an interview held in August 2022. "I hope that my mother is now free from pain and embarking on a new journey that I envision as her eternal freedom."

In September, Homer initiated the process of obtaining legal control over his mother's assets, as it was discovered that Heche had not left behind a written will. However, a 58-year-old named Tupper declared that the actress had bequeathed her estate to him. According to documents obtained by Us, he claimed that Heche clearly expressed her intentions in an email sent in January 2011.

"If, by any chance, I pass away tomorrow and someone inquires, I want to clarify my wishes," stated the purported email. "I would like all of my assets to be placed under the control of Mr. James Tupper, to be utilized for the upbringing of my children, and subsequently transferred to them. The assets shall be divided equally amongst our current children, namely Homer Heche Laffoon and Atlas Heche Tupper, and each share shall be given to them when they reach the age of 25. Once the youngest child reaches 25, any houses or other owned properties may be sold, with the resulting funds being distributed equally amongst our children."

Homer later criticized Tupper for his baseless personal attacks against him.

Homer refuted Mr. Tupper's assertions about Homer's appropriateness as a personal representative in court documents, dismissing them as irrelevant, incorrect, and baseless. After two months, Homer was formally designated as the overall administrator of Heche's estate. Despite the preceding legal turmoil, Homer announced in January his intention to publish Heche's unreleased memoir.

Homer expressed his commitment to informing her community about her unfinished work and the enthusiasm she had to share it herself. He mentioned that his mother had finished writing a second book before her death, which was a continuation of her efforts to share her story and assist others. According to him, the book, titled "Call Me Anne," was a significant achievement for his mother, who eagerly wanted to share it with the world. In honor of her, he took it upon himself to share the book with her community and hoped that it would thrive and have an independent existence, just as she had desired.
