In an earlier episode of Billy the Kid season 2, Baker had contemplated taking advantage of the opportunity to kill Billy, as the Jesse Evans Gang had betrayed The Regulators after breaking them out of prison. However, Billy wasted no time in seeking revenge for Tunstall's death, efficiently dispatching both suspected culprits for their involvement in the ambush on Tunstall. Murphy devises a plan to have Sheriff William Brady apprehend McSween the next time he enters town and frame him with an accessory to murder charge for the deaths of Baker and Morton. They plan for Sheriff William Brady, previously suspected by Dick Brewer of being bribed by the Murphy House, to await McSween's arrival with his wife on the outskirts of town in order to serve him an arrest warrant and take him into custody. Billy the Kid and The Regulators stealthily enter the town and commence a barrage of gunfire targeting Sheriff Brady, resulting in his demise from multiple gunshot wounds. A fierce gunfight erupts between the Jesse Evans Gang and the Regulators, leading to numerous casualties and violence on both sides. With the assistance of the McSweens, Billy the Kid and the wounded Tom receive essential care, while the Regulators persist in their shootout against the Jesse Evans Gang. Driven by his eagerness to return and support his comrades, Billy supplies Tom with nourishment, water, and a blanket, ultimately concealing him beneath the floorboards of the McSween house.

Dulcinea even went to the extent of expelling Billy from her home once she discovered his intentions.
