Former Republican Rep. Liz Cheney warned on Monday that if the Supreme Court does not promptly and definitively address the issue of presidential immunity, it could greatly harm the country.
In her Op-Ed for the New York Times, Cheney emphasized that if there is a delay in resolving the Trump case this year, crucial historical evidence from the grand jury may never be revealed to the public, and the individual most accountable for the events of January 6 may never be held accountable.
Her message comes before the high court is scheduled to hear arguments in the case involving whether Trump can claim immunity from prosecution in the federal election subversion case.
Special counsel Jack Smith, who filed the criminal charges, is working to accelerate the proceedings related to Trump's immunity claim in order to bring the case to trial promptly.
Trump has suggested to the justices that if they are not willing to give him complete immunity from Smith's election subversion prosecution, they should send the case back to lower courts for further proceedings. This would delay the trial for several months while they figure out if any partial immunity could apply in his situation.
This alternative approach could give the conservative majority in the court a way to limit the power of the special counsel without making a blanket decision on immunity for ex-presidents.
Cheney mentioned that there is important information about Trump's actions that may not be revealed until the special counsel brings the case to trial. She believes that this evidence should be shared in court for everyone to see. This way, the public can understand what happened on January 6th and consider what kind of actions a person like Trump could take if given presidential power again.
“The Supreme Court should understand this reality and conclude without delay that no immunity applies here,” she said.
