Olivia Wilde and Jason Sudeikis’ children’s former nanny, Ericka Genaro, has appealed the court’s decision to move the case to mediation.
“We strongly object to the judge’s decision of transferring this case to private arbitration and are actively exploring all options to overturn the ruling in order to have a trial by jury,” stated Ron Zambrano, lawyer for Genaro. “We firmly believe that the judge failed to consider the actual evidence presented in relation to the applicable law, which would have rendered the agreement unenforceable.”
Zambrano further emphasized, “The evidence substantiating our claims is overwhelming, including text messages and testimony demonstrating that she was forced to quit and subsequently terminated unfairly. Ms. Wilde and Mr. Sudeikis are simply attempting to silence Ms. Genaro by insisting on arbitration. We firmly assert that they should not receive preferential treatment solely due to their celebrity status and should be held accountable in a court of law, facing their accuser.”
On Tuesday, October 3, Genaro filed an appeal in California's 2nd District Court of Appeal, arguing that granting Wilde and Sudeikis' motion to move the case from a courtroom setting to arbitration was a mistake. Wilde and Sudeikis have been contacted for comment. Us confirmed in February that Genaro included Wilde, 39, and Sudeikis, 47, in her lawsuit, alleging wrongful termination as the nanny for their children Otis, 9, and Daisy, 6. Genaro had been the nanny for Otis and Daisy since 2019 until she was allegedly let go due to the anxiety and depression resulting from her employment.
Genaro asserted that Wilde abruptly departed from the family home in 2020 after ending her relationship with the Ted Lasso star, causing negative effects on Sudeikis' emotional well-being. The nanny also claimed that Sudeikis began relying on her for support, urging her to stay up late to discuss their breakup, which she felt compelled to participate in due to him being her employer. Genaro then relayed the conversations to Wilde, who appeared sympathetic to her concerns. Sudeikis informed Genaro later on that Wilde had informed him about their discussion.
Following their split in November 2020 and Wilde's subsequent relationship with Harry Styles, Wilde and Sudeikis refuted Genaro's allegations. Earlier this year, they confirmed their intention to drop the case entirely.
"It is unfortunate that the media continues to bring attention to this personal matter. Our main focus has always been and will remain protecting our family against any form of harassment," Wilde and Sudeikis told Us in a joint statement in May. "We are confident that the evidence presented will support our position to promptly dismiss this case and bring peace to our family."
They also alleged that Genaro and her legal team wrongly filed the lawsuit as a civil case in California instead of taking it to the American Arbitration Association (AAA) for mediation in New York. In their efforts to dismiss the lawsuit, Wilde and the Saturday Night Live alumnus will present their grievances to the AAA.
Wilde and Styles, who ended their relationship in November 2022, currently co-parent Otis and Daisy. In September, they reached an agreement on child support, with Wilde receiving $27,500 per month as agreed upon by the Kansas native.
