California Jogger Faces Charges for Fatally Shooting Homeless Man on Video, Officials Report

The Orange County district attorney reported that a man in Southern California, Craig Sumner Elliott, filmed himself shooting and killing a homeless man who was blocking a sidewalk as he woke up. The incident occurred in Garden Grove on September 28 while Elliott was jogging with his dogs. The homeless man, Antonio García Avalos, was 40 years old.

Elliott, who had a pushcart, used it to nudge Avalos in an effort to wake him up and get around him, as stated in the release. Upon waking, Avalos yelled at Elliott to stay away from him. Elliott, who is facing charges of felony voluntary manslaughter and felony enhancement of personal use of a firearm, allegedly grabbed a handgun from his pushcart, as per the release.

CNN was unable to find any contact information for Elliot's attorney.

According to the district attorney's office, Elliot had an active concealed carry permit from the Orange County Sheriff's Department at the time of the shooting.

According to authorities, a video recorded by Elliot depicts Avalos getting up and throwing a shoe at Elliot, who quickly dodges the footwear. Shortly after, the video captures Elliot shooting Avalos three times. Avalos succumbed to his injuries and passed away later on, as stated in the release.

Elliot was arrested by the Garden Grove Police Department on November 17 under a warrant and was later released on November 20 after posting a $100,000 bail. He is set to be arraigned on December 15. The district attorney stated that he could potentially face a maximum sentence of 21 years in state prison.
